Repeat Domestic Violence Suspect Tased After Struggle with Deputies

A Marion County man who deputies had been searching for in connection with a domestic battery case was taken into custody Monday afternoon after what investigators described as a volatile encounter at a residence involving resistance and injuries to deputies.

According to arrest affidavits from the Marion County Sheriff’s Office, Charles Robert Scarbrough-Wimmer, 32, was arrested March 16 following a 911 call reporting a woman screaming for help during what a caller described as a fight between a male and female.

Deputies responded to the residence and made contact at a screened-in porch, where they observed a woman crying with her face in her hands. Scarbrough-Wimmer was seated nearby. The porch door was locked, and deputies reported the man refused to allow them inside to conduct a welfare check.

Investigators noted several factors that led them to force entry, including the active 911 call, the woman’s visible distress, and prior knowledge that Scarbrough-Wimmer had already been the subject of a separate domestic battery investigation involving the same victim.

Deputies made entry and attempted to place Scarbrough-Wimmer under arrest. According to the report, he initially refused commands and then actively resisted efforts to be handcuffed. Deputies also observed a knife in his waistband during the encounter.

The situation escalated into a physical struggle inside the confined porch area. Deputies reported that Scarbrough-Wimmer tucked his arms, pushed into deputies, and knocked them off balance, causing minor injuries, including cuts to a deputy’s hands and arm. A taser was ultimately used to gain compliance, after which he was taken into custody.

He was charged with resisting an officer without violence and two counts of battery on a law enforcement officer. He was also served on an existing probable cause warrant stemming from a February incident.

That earlier case, dated February 20, involved a domestic dispute at the same residence. According to that affidavit, deputies responded after neighbors reported hearing a woman yelling “get off of me” and “call 911.” The victim told deputies she had been in an on-and-off relationship with Scarbrough-Wimmer for approximately seven years and had recently reconciled with him.

During that incident, the victim reported that an argument began when she attempted to have him leave the residence. She told deputies he grabbed a half-gallon of milk and poured it over her head. Deputies observed her hair to be wet with a substance consistent with milk. Scarbrough-Wimmer was not located at the time, leading to the issuance of probable cause for his arrest.

Authorities had been attempting to locate him since that February incident.

The March 16 arrest ultimately brought both cases together, with deputies taking him into custody on the prior domestic battery charge as well as the new charges stemming from Monday’s confrontation.

He was transported to the Marion County Jail. No bond was listed in the reports.
