MCSO: Summerfield Man Arrested for DUI With Children in Vehicle

A Summerfield man was arrested following a traffic stop on East Highway 40 late Tuesday night after deputies reported two children were in the backseat of a vehicle he was driving while impaired.

According to an arrest affidavit from the Marion County Sheriff’s Office, deputies stopped a black pickup truck around 10:46 p.m. on April 7 in the 17200 block of E. Highway 40 in Silver Springs after observing the vehicle swerving and failing to maintain its lane.

The driver, identified as Daniel Flynn, showed signs of impairment upon contact, including slurred speech and difficulty locating his driver’s license, deputies reported. An odor of alcohol was also detected.

During the stop, deputies observed multiple open containers of alcohol inside the vehicle, including beer and small liquor bottles within reach of the driver. Two children were also found seated in the back of the truck, which resulted in an enhanced DUI charge.

Field sobriety exercises were conducted roadside. According to the report, Flynn showed multiple indicators of impairment during the exercises, including difficulty maintaining balance, failing to follow instructions, and swaying.

Deputies also located ammunition under the driver’s seat during a vehicle inventory search. A records check confirmed Flynn had a prior felony conviction, making it unlawful for him to possess ammunition.

At the Marion County Jail, deputies reported Flynn provided inconsistent breath samples. One partial reading registered at 0.173, but deputies noted he failed to provide sufficient samples after multiple attempts, resulting in an additional charge for refusal to submit to testing.

Flynn was charged with driving under the influence with persons under 18 in the vehicle, refusal to submit to a DUI test after license suspension, and possession of ammunition by a convicted felon.

He was transported to the Marion County Jail without incident. Bond information reflects $1,000 on the DUI charge, with no bond listed on the remaining charges.
