An Ocklawaha man already under arrest for domestic battery added to his legal troubles Sunday night after deputies say he spit, kicked, and even flung a urinal at them while at Ocala Regional Hospital.
Christopher Russell Harvey, 37, had been taken into custody earlier that evening on a felony domestic battery charge, according to a Marion County Sheriff’s Office report. Deputy Alexander Heber said Harvey was cuffed to a hospital bed in Room 12 when he asked to use the restroom. When told medical staff would assist him, Harvey threatened to urinate on the floor.
Staff provided him with a handheld urinal, but instead of calming down, Harvey allegedly became more aggressive. Heber reported Harvey cursed at deputies and warned, “You can only hold me for so long before I go on a god damn killing spree.” Moments later, Harvey spit on Heber, striking his face and chest, according to the affidavit.
As Heber moved closer to the door, Harvey threw the used urinal against the wall, narrowly missing him. Deputies then attempted to secure Harvey more firmly to the bed, but he continued to resist. While Heber was double-locking Harvey’s handcuffs, Harvey allegedly kicked toward the deputy’s head, striking him multiple times. Heber said he was hit four times in total before medical staff helped place ankle restraints on Harvey’s legs.
Even after being restrained, Harvey reportedly boasted about the attack, telling a nurse, “I hit him a bunch of times,” and claiming, “I f***ed his ass up. Seven times I hit him in the face with my leg,” while pointing at the deputy.
Harvey, who has a prior conviction for domestic battery, now faces two counts of battery on a law enforcement officer. Court records show no bond was set in the case.
